Terms of Use

This website (hereinafter referred to as the “Site”) is managed and operated by Nagasaka Corporation (hereinafter referred to as the “Company”). These Terms of Use (hereinafter referred to as the “Terms”) set forth the legally binding terms governing your use of any content provided on the Site (hereinafter referred to as the “Content”). Please read the Terms and Privacy Policy carefully before using the Site. If you do not agree to the Terms, you must not access or use the Site. By using the Site, you agree to all of the terms and conditions described in these Terms and the Privacy Policy.

Article 1. Scope of Application

  • The Terms shall govern all relations between the user and the Company with respect to the use of the Content.
  • In addition to the Terms, the Company may establish additional rules for the use of the Content (hereinafter referred to as “Specific Rules”). The Specific Rules, regardless of their name, shall constitute a part of the Terms.
  • In the event of any conflict between the provisions of the Terms and those of the Specific Rules, the provisions of the Specific Rules shall supersede, unless otherwise specified in the Specific Rules.

Article 2. Prohibited Acts

  • The following acts are prohibited by the Company in using the Site:
    1. Acts that infringe or may infringe on the intellectual property rights, other rights, or privacy of the Company, or any third party;
    2. Acts that serve or may serve to defame the reputation of or discredit the Company or any third party;
    3. Acts that cause or may cause disadvantage or damage to the Company or any third party;
    4. Acts that are or may be contrary to public order or morality;
    5. Acts that lead to or may lead to criminal activities;
    6. Acts that use the Site for business activities or commercial purposes;
    7. Acts of making false statements or registrations, such as the use of an e-mail address belonging to a third party;
    8. Acts that use or provide harmful programs including computer viruses;
    9. Acts that interfere with the operation of the Site, such as unauthorized alteration of the Site, and disruption of server communication;
    10. Other acts that violate or may violate laws, regulations, or ordinances; and
    11. Other acts that the Company deems inappropriate.
  • In the event the Company discovers any violation of the above-prohibited acts, the Company shall, without prior notice to users, delete all or part of the Content in question and shall also take the measures set forth in Article 4.

Article 3. Suspension of Provision of the Content

  1. The Company may suspend or discontinue the provision of all or part of the Content without prior notice to users in any of the following cases:
    1. When performing maintenance or upgrades of the computer system related to the Content;
    2. When provision of the Content becomes unreasonably burdensome due to force majeure such as earthquakes, lightning strikes, fire, power outages, or natural disasters;
    3. When computers or communication networks, etc. become inoperable due to an accident; and
    4. In any other cases where the Company deems the provision of the Content difficult.
  2. The Company shall not be liable for any disadvantage or damage suffered by the user or any third party as a result of the suspension or discontinuance of the provision of the Content.

Article 4. Use Restriction

  1. The Company may restrict the use of all or part of the Content by the user without prior notice to the user, if the user falls under any of the following:
    1. If the user has violated any of the provisions of the Terms; and
    2. In any other cases where the Company deems the use of the Content inappropriate.
  2. The Company shall not be liable for any disadvantage or damage suffered by the user or any third party as a result of the restriction on the use of the Content provided for in the preceding paragraph.

Article 5. Attribution of Rights

  1. All information on the Site is subject to the copyright and other rights of the Company or its licensors. It may not be used (including reproduction, alteration, and distribution) without permission beyond the scope of personal use or other use permitted by law.
  2. Trademarks (trademarks and service marks) used on the Site are owned by the Company or the licensors, and may not be used without permission.
  3. The contents of e-mails sent by the Company to the users are also subject to the copyright of the Company, and may not be diverted or reprinted without permission.
  4. The Company shall be free to use and make secondary use of any information provided by users when using this Site, except for those related to personal information (information as defined in Article 2, Section 2 of the Act on the Protection of Personal Information [Act No. 57 of 2003], hereinafter referred to as “Personal Information”), to the extent necessary for providing, improving, or introducing this service, without notifying the users.

Article 6. Disclaimer

  1. The Company makes no warranty, express or implied, that the Content is free from any factual or legal defect (including, but not limited to, defects as to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors and bugs, and non-infringement).
  2. The Company shall not be liable for any damages suffered by users arising out of the Content, except in cases of intentional or gross negligence on the part of the Company.
  3. The Company shall not be liable for any transactions, communications, or disputes between users, or between a user and a third party arising out of or in connection with the Content.

Article 7. Changes to the Content

The Company reserves the right to modify, add to, or discontinue the Content without notice, and users shall accept such modifications, additions, or discontinuance.

Article 8. Amendment of the Terms of Use

The Company may amend the Terms without requiring the individual consent of users in the following cases:

  1. When the amendment of the Terms is found to conform to the common interests of the users; and
  2. When the amendment of the Terms is not contrary to the purpose of the Content, and is reasonable in light of the circumstances concerning the amendment such as the necessity of the amendment, and the appropriateness of the details of the amended conditions.

Article 9. Handling of Personal Information

The Company shall appropriately handle Personal Information collected through the use of the Content in accordance with the Privacy Policy set forth by the Company.

The following are recommended system requirements for an optimal experience on this Site. Some parts of the Site may not be used if the requirements are not met (As of November 1, 2023).

Article 11. Governing Law and Jurisdiction

  1. The Site and the Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any dispute arising out of or in connection with the Content shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
